1. Acceptance of Terms

By creating an account on HQFam ("we," "us," or "our") at hqfam.com, you ("User," "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and HQFam. Please read them carefully before proceeding.

2. Description of Service

HQFam is a family management platform that allows parents to manage chores, rewards, challenges, budgeting, and household operations through a parent dashboard ("Hub") and a child-facing application ("App"). Features vary by subscription plan (Basic, Family, or Premium).

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where possible.

3. Accounts and Eligibility

3.1 Account Registration

You must be at least 18 years old to create an account. By registering, you represent that all information provided is accurate and complete. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Family URL (Slug)

During signup you choose a unique family URL (e.g., hqfam.com/app/yourfamily). This slug is reserved for your family's exclusive use and cannot be transferred. Slugs that violate these Terms or contain offensive content may be reclaimed at our discretion.

3.3 One Account Per Family

Each subscription covers one household. Creating multiple accounts to circumvent plan limits is prohibited and may result in account termination.

4. Free Trial

48-Hour Free Trial: New accounts receive a 48-hour free trial period. Your payment method is required at signup but will not be charged until the trial period ends. You may cancel at any time during the trial at no cost.

Only one free trial is permitted per household. If you cancel during the trial and re-subscribe with the same email address or payment method, the trial will not apply again. We reserve the right to modify or discontinue the trial offer at any time.

5. Payments and Billing

5.1 Subscription Plans

HQFam is offered on a recurring subscription basis. Current pricing:

  • Basic: $4.99/month or $3.99/month (billed annually at $47.88/year)
  • Family: $9.99/month or $7.99/month (billed annually at $95.88/year)
  • Premium: $19.99/month or $15.99/month (billed annually at $191.88/year)

All prices are in U.S. dollars and exclude applicable taxes.

5.2 Automatic Renewal

Subscriptions renew automatically at the end of each billing period. You authorize us to charge your payment method on file for each renewal until you cancel. We will notify you by email before any price changes take effect.

5.3 Payment Processing

Payments are processed securely by Stripe, Inc. Your card details are never stored on HQFam servers. By providing a payment method, you agree to Stripe's Terms of Service.

5.4 Failed Payments

If a payment fails, we will attempt to retry the charge and notify you by email. Access to the Service may be suspended until payment is successfully collected.

5.5 Taxes

You are responsible for any applicable sales tax, VAT, or similar taxes based on your location. We may collect such taxes where required by law.

6. Cancellation and Refunds

6.1 How to Cancel

You may cancel your subscription at any time through the Billing section of your Hub dashboard. Cancellation takes effect at the end of your current billing period — you retain full access until then.

6.2 Refund Policy

We offer refunds in the following circumstances:

  • Cancellation during the 48-hour free trial period — no charge applies
  • Accidental duplicate charges — full refund issued promptly
  • Service outage exceeding 72 consecutive hours — prorated credit or refund at our discretion

Outside of the above, all subscription fees are non-refundable. We do not issue prorated refunds for unused portions of a billing period.

6.3 Account Data After Cancellation

After cancellation, your family's data is retained for 30 days, during which you may reactivate your subscription to recover it. After 30 days, data is permanently deleted and cannot be recovered.

7. Children and COPPA Compliance

Important: HQFam is designed to be used by parents on behalf of their children. The children's features of the App are accessed and supervised by the subscribing parent or legal guardian.

7.1 Parent Responsibility

HQFam accounts are created by and for adults (18+). Parents control all access for their children. Children use the App only through PIN or biometric authentication set up and managed by their parent.

7.2 Children Under 13 — COPPA

The Children's Online Privacy Protection Act (COPPA) requires that we obtain verifiable parental consent before collecting personal information from children under 13. By adding a child profile to HQFam, you (as the parent or legal guardian) provide this consent on their behalf.

We collect minimal data about children — only what is necessary to provide the Service (name, age, chore completion records, earned points). We do not sell children's data, share it with third parties for advertising, or use it for any purpose other than delivering the Service.

7.3 Deletion of Child Data

You may delete a child's profile at any time through the Hub dashboard. Upon deletion, all data associated with that child profile is permanently removed within 30 days. You may also contact us at privacy@hqfam.com to request removal of any child's data.

8. Email Communications

8.1 Transactional Emails

By creating an account, you agree to receive transactional emails necessary to deliver the Service, including:

  • Account confirmation and welcome messages
  • Emergency access code delivery
  • Payment receipts, invoices, and billing alerts
  • Password reset and security notifications
  • Service status and important account updates

These emails are essential to the Service and cannot be opted out of while you hold an active account.

8.2 Marketing Emails

We may send promotional emails about new features, tips, and offers. You can opt out of marketing emails at any time using the unsubscribe link in any email or by contacting us at hello@hqfam.com. Opting out of marketing emails does not affect transactional communications.

8.3 Email Storage and Delivery

Emails are queued and sent using third-party email delivery providers. Delivery is not guaranteed and may be delayed by spam filters or network issues. We are not liable for damages caused by email delivery failure.

9. Acceptable Use

You agree not to use HQFam to:

  • Violate any applicable local, state, national, or international law or regulation
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Upload or transmit viruses, malware, or any other malicious code
  • Use automated scripts to scrape, crawl, or stress-test the Service
  • Resell, sublicense, or commercialize the Service without written permission
  • Impersonate another person or misrepresent your affiliation with any person or entity

Violations of this section may result in immediate account termination without refund.

10. Intellectual Property

All content, design, code, trademarks, and materials comprising HQFam are owned by or licensed to HQFam and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended personal, non-commercial household use.

You retain ownership of any content you upload (such as custom shop item images). By uploading content, you grant HQFam a non-exclusive license to store and display it for the purpose of delivering the Service to you.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. You use the Service at your own risk.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HQFAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, REVENUE, OR PROFITS — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) $100 USD.

13. Termination

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, if you breach these Terms or engage in conduct we determine to be harmful to the Service, other users, or third parties.

Upon termination, your right to use the Service ceases immediately. Sections 7, 10, 11, 12, and 13 survive termination.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via email and update the "Last updated" date at the top of this page. Continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.

We encourage you to review these Terms periodically. If you disagree with any updates, your only remedy is to cancel your subscription and stop using the Service.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved in the courts of Delaware.
